Description of Service

ArmProgress is a fitness tracking application designed specifically for arm wrestling and strength training enthusiasts. The App provides tools to:

• Log and track workout sessions
• Record strength test results
• Monitor body measurements
• Upload profile pictures and group avatars
• Generate and share progress reports as images
• Set and track fitness goals
• Create training cycles and schedules
• Receive training reminders
• Access premium features through subscription

Note: Progress photo tracking (before/after body photos over time) is a planned future feature.

Eligibility

You must be at least 13 years of age to use ArmProgress. If you are between 13 and 18 years of age, you must have permission from a parent or legal guardian to use the App.

By using the App, you represent and warrant that:

• You meet the age requirements
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations

Account Registration

Creating an Account

To use certain features of the App, you must create an account. You may register:

• With an email address and password
• Through third-party authentication (Google, Apple, Facebook)

Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

We are not liable for any loss or damage arising from your failure to protect your account information.

Account Accuracy

You agree to provide accurate, current, and complete information during registration. All registration fields (email address, full name, and password) are mandatory and cannot be modified after account creation.

Subscription and Payment Terms

Free Tier

ArmProgress offers a free tier with basic features and advertising. Free tier users may see advertisements provided by Google AdMob.

Premium Subscription

Premium subscriptions ($4.99/month or $39.99/year) provide:

• Ad-free experience
• Advanced analytics with 6 chart types
• PR timeline and consistency tracking
• Body measurements tracking
• Detailed progress reports
• Unlimited goals
• Unlimited workouts
• Unlimited scheduled trainings
• Unlimited training cycles
• Priority customer support

Billing

• Subscriptions are billed through the Apple App Store or Google Play Store
• Subscription fees are charged to your app store account
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period

Price Changes

We reserve the right to modify subscription prices. Price changes will:

• Be communicated to you in advance
• Not affect your current subscription period
• Apply to subsequent renewal periods

Cancellation

You may cancel your subscription at any time through your app store account settings:

• iOS: Settings > [Your Name] > Subscriptions
• Android: Google Play Store > Account > Subscriptions

Cancellations take effect at the end of the current billing period. You will retain access to premium features until that time.

Refunds

All subscription payments are processed through the Apple App Store or Google Play Store. Refund requests must be submitted through the respective app store and are subject to their refund policies. We do not have access to or control over app store refund processes.

User Content

Your Content

You retain all rights to the content you create and upload to the App, including:

• Workout data
• Profile pictures and group avatars
• Personal notes
• Body measurements
• Goals and training plans

License to Use Your Content

By uploading content to the App, you grant us a limited, non-exclusive, royalty-free license to:

• Store and display your content within the App
• Process your content to provide App functionality
• Create aggregated, anonymized analytics (with no personally identifiable information)

Research Data Export (Optional)

If you explicitly opt-in via the Profile settings, we may export anonymized, aggregate training statistics to PostHog for armwrestling training science research purposes. This includes:

• Workout type distributions (e.g., 40% strength, 30% technique)
• Average workout duration and intensity
• Exercise type distributions
• Training cycle patterns
• Goal completion rates (not target values)

What is NEVER exported: No personally identifiable information, body measurements, strength test results, goal targets, or personal notes are ever shared.

You can revoke this consent at any time in Profile settings, and weekly exports will cease immediately.

Content Restrictions

You agree not to upload, post, or transmit content that:

• Is illegal, harmful, threatening, abusive, or harassing
• Violates any intellectual property rights
• Contains viruses or malicious code
• Impersonates any person or entity
• Contains private information of third parties without consent

Content Removal

We reserve the right to remove any content that violates these Terms or is otherwise objectionable, at our sole discretion.

Prohibited Uses

System Abuse

You agree not to:

• Attempt to gain unauthorized access to the App or related systems
• Interfere with or disrupt the App's functionality
• Use automated systems (bots, scrapers) to access the App
• Reverse engineer, decompile, or disassemble the App

Misuse

• Use the App for any illegal purpose
• Violate any local, state, national, or international law
• Transmit any harmful code or malware
• Harass, abuse, or harm other users
• Impersonate any person or entity

Commercial Misuse

• Use the App for unauthorized commercial purposes
• Resell or redistribute App content or services
• Create derivative works without permission

Violation of these prohibitions may result in immediate termination of your account and potential legal action.

Intellectual Property Rights

Our Rights

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by ArmProgress, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

Trademarks

The ArmProgress name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of ArmProgress. You must not use such marks without our prior written permission.

Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Access and use the App for personal, non-commercial purposes
• Download and use the mobile application on devices you own or control

Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our privacy practices.

Third-Party Services

Third-Party Links

The App may contain links to third-party websites, services, or resources. We are not responsible for:

• The content or availability of third-party services
• Any transactions between you and third-party providers
• The privacy practices of third-party services

Third-Party Authentication

If you sign in using Google, Apple, or Facebook, you agree to comply with their respective terms of service and privacy policies.

Payment Processing

Subscription payments are processed by Apple App Store or Google Play Store. You agree to comply with their terms of service.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARMPROGRESS SHALL NOT BE LIABLE FOR:

Damages

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Business interruption
• Loss of goodwill or reputation

Maximum Liability

Our total liability to you for all claims arising from your use of the App shall not exceed:

• The amount you paid us in the 12 months prior to the event giving rise to liability, OR
• $100 USD, whichever is greater

Termination

Termination by You

You may terminate your account at any time by:

• Using the account deletion feature in the App
• Contacting us at support@armprogress.com

Termination by Us

We reserve the right to suspend or terminate your account and access to the App, with or without notice, for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Any reason at our sole discretion

Effect of Termination

Upon termination:

• Your right to access and use the App will cease immediately
• Your data may be deleted according to our retention policies
• Provisions that should survive termination will remain in effect (including disclaimers, limitations of liability, and dispute resolution)

Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at support@armprogress.com. We will attempt to resolve the dispute informally within 60 days.

Class Action Waiver

You agree to bring claims against us only in your individual capacity and not as a plaintiff or class member in any class or representative action.

General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and ArmProgress regarding the App.
• Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
• Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms without restriction.
